      Is the addition of balconies to an existing strata scheme considered 'development' or just 'renovation and improvement?'  I believe that there have been changes to the Strata Act that affect development in strata schemes and it would be greatly appreciated if someone could provide some advice on what these changes are.

          Hi Chris,

          The context (a fairly common one I believe in stratas) is that some owners in our strata would like to add balconies to either all units or some units, other owners do not want balconies on their units but are happy for other owners to have them, while other owners do not want balconies at all.

          I am undecided at this stage. While I see the advantages of balconies I have also seen the time and cost involved when other stratas have done this. However it makes it hard to decide when one is unsure what the current strata laws/procedures are eg. what happens to unit entitlements; what are the Council requirements such as parking, and compliance; is it permissable to have some units at the front of the building but none at the back; or wrap-around balconies that protrude round the sides of the buildings?

          I understand this is a complex issue and I don't expect answers to all the questions but some general guidelines might be a help.
