      Firstly I’ll apologise in advance as I’m sure this topic has been covered in the past but I’ve given up searching for it.

      Is it an issue when a real estate for sale ad includes an extra car space that isn’t on the title? The unit has a garage and the agent is implying that the space in front of the garage is “right of way parking”. Although parking isn’t technically permitted on common property often a blind eye is turned if it’s not affecting anyone.

      Mind you, the only reason this spot isn’t affecting anyone at the moment is because the garage next to it is owned by an elderly couple who don’t have a car, otherwise it would be quite difficult to get a car out of that garage with someone parked in the driveway (could be done but would have to drive on the grassy edge to get around) – but that’s beside the point.

      My head tells me that it’s up to the prospective owners to check the contract, however I can’t help but think this is possibly inviting trouble for the future.

      I’ve emailed the agent but haven’t received a response. What would you advise we do?

        If the situation is misrepresented by the real estate agent or the previous owner, not the owners corporation, then that is not your problem. 

        The EC could write to the agent to advise that their ad is inaccurate. 

        We had a good experience with a selling agent a few years ago. We let them know that a fence was not approved or approvable (wrong style and enclosing part of the common property) and the new owner would be required to remove it. The agent explained to all prospective purchasers who looked serious. The new owners promptly removed the fence.

        I think most agents try to get it right and yours might have been misled or misunderstood advice from their clients.
