      Hi, I recently replaced an old air con but placed the external unit on the outer wall of my lot (its a townhouse complex) instead of the ground like the old one. The by-law that control new air-con installation will be proposed in 2-3 days from my posting in the AGM (There is no topic about my request there). I asked approval to the OC 3 weeks prior to the meeting and put photos of other units doing the same thing with worse effect to the aesthetic view as there is a by-law that any owner of the lot must maintain within the lot anything visible from the outside that viewed from outside, is not keeping with the rest of the building. The OC didn’t provide any response to my request for weeks until someone saw the installation completed and reported it (most likely part of the SC). They then returned to me saying its approved but the external unit must be on the ground so I have to take it down. I have a hunch that they deliberately delayed the response so they can control my installation.

      My questions are:

      1. The air con has been installed. I then replied to the OC that I will cover it with something painted with the same colour as my brick wall so this won’t breach the existing by-law. I have yet to receive their response.

      2. The strata mgr said when they switched to the current strata, they decided to give amnesty to the previous installations. Is there any legislation that saying mine can’t be part of this? I can’t find anything about this on the web.

      3. Below is the proposed by-law. Can this be retrospectively applied to mine?It says wishing to install and not already installed.

      BY-LAW – AIR CONDITIONER INSTALL (suggested time 7 mins)
      The Owners – Strata Plan No. XXXXX SPECIALLY RESOLVES pursuant to sections 136 and 141
      of the Strata Schemes Management Act 2015 (“the Act”) to make an additional by-law on the
      following terms and that notification of this change to the by-laws be lodged

      2. Compliant Air-Conditioning Unit
      2.1 An owner wishing to install an Air-Conditioning Unit in their Lot may do so subject to
      complying with the following conditions:
      (a) The Air Conditioning Unit is to be of a split system design;
      (b) The external condenser unit, if mounted on anything other than grass, must be mounted on
      rubber anti-vibration pads;
      (c) The external condenser unit must be situated so as to not interfere with the peaceful
      enjoyment of neighbouring Lots with regard to noise, exhaust air direction and aesthetics;
      (d) The external condenser unit must be situated so as to not be visible from the common
      property or outside the Strata Scheme;
      (e) The power point is to be installed below the height of the balcony railing and be visually
      unobtrusive;
      (f) All condensate lines must be connected directly to the building plumbing and no water is to
      run freely onto the building;
      (g) All electrical, refrigerant and condensate lines are to be screened by conduit;
      (h) Adequate electrical circuits must be allowed for the safe operation of the Air-Conditioning
      Unit;
      (i) The Air Conditioning Unit must be installed in accordance with the WH&S Act and WH&S
      Regulation relating to “falls from heights” specifications; and
      (j) The Air Conditioning Unit
