We have a process in place whereby owners can apply to improve their lots and where that involves the common property attached to their lot it will be at their cost and ongoing maintenance of the renovations (including the CP) will be the lot owner’s responsibility. Any damage to the CP during the renovations has to be fixed by the lot owner.
What is the situation however where an owner has the necessary approvals, starts the work, removes common property, in this instance bathroom floor and boundary wall tiles, but has run out of money and can’t finish the job, at least in the foreseeable future?
Would the OC be obligated to restore the common property or can we leave the CP in its present state in the hope that sooner or later the lot owner can finish the job. Can we legally force him to restore the CP?
