Is it appropriate for the builder/ developer who is a member of the EC to be involved in discussions about appointing a consultant for the building defects process?
Our EC is going through the process of organising a building defects inspection. The builder/ developer is on the EC this year after an absence of a few years.
The builder has avoided any requests to fix anything in the past. The managing agent hasn't provided any guidance in the process, despite repeated requests. The managing agent was introduced to the site by the developer, and they have an ongoing commercial relationship with the developer.
I think that the builder/ developer should excuse themselves from discussions about appointing a consultant.
Our EC sounds typical of many; some hardworking, some disinterested, some tired and one office bearer has an ongoing commercial relationship with the builder/developer
Any advice would be appreciated.
