    We belong to a large Strata and wondered if a by-law can be changed or repealed and how this would have to happen.

     

    Is is binding if part of the by-law states that the by-law cannot be changed or revoked by the owners corporation without the express consent of a particular lot owner?

      That is one of the conditions applied to an exclusive use by-law.  It protects the owner concerned from spending time and money of developing an area of common property and then having the permission to use it revoked.

      It is also includes a no-competition clause – who decides if another business is classified as ‘competition’? This strata scheme also includes commercial premises.
