    Is there a conflict of interest if the Strata Manager rents a unit in the strata complex from the Chairman of the EC?

      My response to that general situation is NO, but if you can perhaps elaborate upon the specifics that have led you to ask the question, the response may be different.

      Hello,  The Chairman of the EC owns a unit in our Strata block.  We understand that the Strata Manager – who is, by the way, very chummy with the Chairman – is thinking of renting the unit owed by the Chairman.  I thought that there might be a conflict of interest.  For instance what happens if we change Strata Managers?

        Change the chairman?

        But seriously, if you felt you weren’t getting value for money from your strata manager, you could review the contract and ask the chair to recuse themselves from the vote.

        If the chairman refused to do so, you could put a motion to your EC that the chair be vacated and a new chairman elected.

          Not ideal to have a strata manager who is very very chummy with the Chairman….but that’s another matter.

          Wait until the issue arises and then deal with it.  You can’t stop the Chairman renting his apartment to the strata manager.
