Our E C has demanded that I remove all plants from my townhouse courtyard that exceed the height and/or depth of my airspace (defined as 300mm below ground to 2.2 metres above ground). While they have the right to do this, I and several other owners have quite attractive trees that are much higher than 2.2 metres and almost certainly have deep roots, some of which doubtless stray outside the boundaries of their lot. The E C clearly has no intention of asking other owners to comply with the airspace limits.
Is there a remedy for this? I have noted previously that the NSW tribunal has a reputation for favouring the OC over individual owners.
