Could someone please shed light on the following questions. I cant seem to find a straight answer in the legislation.

Each year we open up all Executive Committee positions to elect a new EC.

Can people use their proxies to vote for or against a nomination?

How do you determine the number of positions on the EC? We do not have any motions on the AGM agenda.

If more nominations come than positions that the meeting decides are appropriate, how do we are for a secret ballot? Is this voted on as well?

Afters years and years of suffering the Executive Committee is wishing to remove the existing chairman. He has been running the building for 50 yrs, he bought off the plan, he is in his late 80s and he dismisses EC motions and does what he wants.

We are seeking to remove him from the EC at this upcoming AGM. The problem is that he usually brings along a bunch of Proxies and he then usually gets his way on any motions.  We need to change this.

We are asking the questions above to clarify how the meeting will need to be run so we can have a fair vote on elections of the EC.

Thank you – love the forum.

I believe by law there has to be a motion on the agenda for the Annual General Meeting, first about the number of people on the EC, at least that’s so in NSW. Then there is the call for nominations and then the vote. I think you said you had a Strata Manager in another post. Surely they know the score, ask them.

There’s work to be done, MrPinkCarpet. You will have to a lot of quiet lobbying ahead of time, behind the scenes, so that by meeting time you have a whole lot of attendees there at the meeting who will nominate you, themselves, or other  like minded people so this bloke and his rusted-on proxies have no chance of a look in. You may get some of your own proxies too (until it’s made illegal to have too many next year) but it is much better having people at the meeting personally voting.

MrPinkCarpet, you may have to be a bit pragmatic about this and point out how bad the ongoing situation you describe has been for your strata. You may win friends and lose some but hey…

      Thanks mate

The majority of the committee are super keen for change but we have all wanted to be respectful as he is an elderly man and this is the main thing that occupies his time and we dont want to crush the poor guy.

Having said all that we would have taken action by now if they guy was same age.  Its gone on too long and we want to fix the situation.

I wont want to engage the Strata Manager as he is best buddies with the Chairman as they have been dealing together for over 20 yrs.  (Another story).

Meeting is this week so I had better get talking to my neighbours.

      Thanks for the info.
