Our 14 lot Strata Scheme in NSW has 8 owner occupied apartments, one apartment used part time by the developer, and 5 unsold Apartments , one of which is leased to a tenant.
Our second annual meeting is coming up in the middle of July and the developer who still owns 46% of the lot entitlements has nominated himself as Chairperson against all other Owners wishes, and has also called for a poll for the voting of office bearers.
in reading the SSMA it seems that even though all other owners have a majority of the unit entitlements, the poll vote may be counted in the same way as a special resolution. Is this correct? How is a poll vote counted and does the OC elect the chair or is that done by the Strata Committee?
