I am in Victoria, and own an apartment in a block of 12 apartments. Ihave owned the propert for two years and managed to attend the first AGM, but didn’t attend the second. I wa sthe only attendee the year i went, and no one attended the 2nd year.

At the first AGM i was told by our unhelpful Management Company that there is no need for a EC because there is only 12 members, so i couldnt join it. When i got the minutes of the meeting though, they indicated that another member was the chairperson. When i question this, they said his role was just statuatory.

My interest in getting in on the EC is because the Owners Corp Managment company do very little for the block. The requests I have made around getting the gardens tidied have been blocked by them, and my request to engage with another owner who had erected a fence on common property was rejected because there details were ‘private’

I guess my question is…are they right in saying that no EC is required, or can i attend the next EC and nominate myself? And i guess by default be made chairperson, if the other member doesnt show up…

Might sound like I’m grabbing for power, but i just want some accountability in the block, of which the managing company are only too quick to avoid…

      Thanks

In Victoria, you don’t NEED to have an executive committee if there are fewer than 13 lots in your block but you can choose to have one.  However, if you do get the Owners Corp to choose to have one (at your next AGM), you will have to find two other members as the minimum size of an EC in Vic is three .

There’s a lot of very valuable information on ECs and other aspects of strata management in Victoria HERE.

There is another avenue you might like to pursue.  As the manager is clearly acting on behalf of the Owners Corp (NB, not the committee) they have to respond to complaints.

So what you need to to is send them a formal complaint about all the things you want done.  Whether they respond or not, you are then able to follow the complaint to Consumer Affairs for mediation and then to The Victorian Civil and Administration Tribunal (VCAT) for a resolution.

You’ll find out more about that – with the required forms – HERE.
