      3 years ago, work was commissioned by the then chairman of our executive committee. The work was very shoddy, yet none of the complaints were actioned.

       

      It has now come to light that the executive committee chairman is in a de facto relationship with the contractor, but did not disclose this conflict of interest with the rest of the OC. Other quotes for the work were submitted at the time, but the contractor in question quoted just under the rest.

       

      That she didn't disclose her relationship, didn't act on complaints and clearly benefitted from the work is more than just unethical, it seems fraudulent and illegal. Does anyone know how we should deal with this? The woman is no longer on the executive committee, but remains a vocal member of the OC. The work amounts to over $4500 to each lot and the rest of the OC is fuming!

        You may have cause for action against the then O/C Member but that is a matter best commented upon by one of the the Strata Lawyers who regularly posts on this site, but in order to attempt to offer any other worthwhile advice / comentary, I (and others) might need to know:

        1. Was the work voted upon at a General Meeting of the O/C or by the Executive Committee?
        2. What was the total value of the work?
        3. Was the Builder Licensed?
        4. Was there a Written Contract between the Builder and the Owners Corporation?

          Thanks! In answer to your questions:

          • Was the work voted upon at a General Meeting of the O/C or by the Executive Committee?

          It was voted on by the O/C as the lowest quote, without knowledge of the connection to the EC chair relationship with the contractor

          • What was the total value of the work?

          Quoted at $64000, an additional $5500 was added after the work was approved but before it commenced.

          • Was the Builder Licensed?

          Yes

          • Was there a Written Contract between the Builder and the Owners Corporation?

          There is no contract on record and the contractor apparently cannot find one.
