Hi all,
We have a fence in our complex that is separating common property from an owners lot that needs repairs.
The strata manager is saying it’s 100% the responsibility of the owner unless there is a special resolution built into the by laws (which there isn’t) however we have just had our sinking fund reviewed and the company who did this has advised fences between common property and individual owners is to be split 50/50 and therefore included repairs to these fences in the proposed sinking fund.
Neither party is able to provide anything specific to define their interpretation of the legislation around this scenario.
This is for Class B units in the ACT
Is anyone aware of specific legislation around this?
