      Our newly elected Executive Committee of seven, and I use the term 'elected' ironically as proxy deals were done, is about to hold their first meeting. The agenda is way too non-specific and waffly, saying this-and-that is going to be 'discussed' with no indication of what might actually be done to fix a number of pressing issues here in our neglected strata of 38 units. There are additional issues previously identified that are simply not there at all.

      One of the new EC members has illegally landscaped the common property outside his ground floor unit. Another has done some building work without warning other residents of the noise and disruption, and it almost certainly breaches the Strata Titles Act and one of our strata's by-laws. This is going to be discussed at the meeting.

      What can I, and no more than a couple of other owners who care about this undesirable situation, do to make sure everything is done properly.

      Be realistic about what you will be able to achieve. Only take on matters which you must deal with by law and make sure you only pick the battles you can win.  

      If you have four meetings a year have a theme for each meeting – 

      1.  The induction executive committee meeting—where new members are briefed by continuing members about the history of the owner’s corporation and the way the executive committee operates.

      2. The service contracts review executive committee meeting—where members review the terms of each of the service contracts for the owner’s corporation and the performance of the service contractors.

      3. The repairs and maintenance review executive committee meeting—where members review issues relating to the physical condition of the common property of the owner’s corporation.

      4. The budget session—where members prepare the budget ahead of the next annual general meeting for the owner’s corporation and discuss the whole agenda of the annual general meeting.

      At the induction meeting you should ensure that all members are armed with a contact list of the members, a copy of the by-laws, strata managing agent contract, service contracts and a copy of the Strata Schemes Management Act. This will ensure you are all well-informed and prepared for your role.

      It would be good to understand if you are on the ec or not and whether you want the ec members vacated their position of office??

      It takes a special resolution at a general meeting to ‘sack’ the ec or individual members.

      It really all comes down to, “do you want to be a part of this community or not” as the next steps will involve conflict with those people who are your neighbors.

        Thank you Simone and Mr Strata.

        I have previously been on the EC but am not currently. I DO want to be 'a part of the community'.

        Call me idealistic but I can't see why, what I believe one of the fundamental aspects of strata living which is protected by the Act: that you don't mess with Common Property without proper permission, can be so blatantly ignored and gotten away with.

        The EC members I mentioned have not and I bet will not make themselves aware of the by-laws and their duties as EC members. They are there purely for self-interest. And there is a general 'laissez faire' and 'live-and-let-live' prevailing attitude amongst the EC, which is fine and may even be desirable, but this means many important issues are ignored.

        There must be a polite way, short of going to mediation at the OFT that they can be encouraged to do things properly, since they put their hand up to be on the EC. And point out the conflict of interest when they are selfishly and greedily breaking the most fundamental by-laws.
