      we have recently begun building works across our large complex and as a result, about 50 residences will be prevented from accessing their garages between 8am and 4pm each day until the works finish (i believe this will be another four months). the problem is that the EC has decided that a large grass area in the front of some townhouses used primarily as a thoroughfare across the complex and by children playing is the new temporary car park.

      one small child walking with her dad was already nearly wiped out by a car as they walked out of their property (car missed her by less than a foot) and it is highly likely to happen again because of poor visuals of cars entering off the driveway etc. 

      those of us in the townhouses have other reasons for wanting this stopped also (our homes are constantly covered in dirt (inside and out) where the cars have destroyed the grass and created  a dust-bowl and our homes are constantly filled with exhaust fumes).

      but the bigger issue really is the danger. should we make an anonymous complaint to the complex insurer, or is there another body that would make a ruling its not safe? – there has to be someone who would look at this situation and see how ridiculous it is and put a stop to it. the EC have no interest at all in addressing the issues and really cannot see how dangerous it is despite being told repeatedly.

        I suggest you contact your Council – this is probably in breach of development consents and conditions.  Also it’s the quickest avenue.

          Did the OC not decide to do and fund the ‘building works’ (whatever they are)? If so, was it not made clear what the temporary alternative access arrangements would be? From the sounds of it, restoring the grassed area after the works end would be part of the overall works cost.

            Rebekah20p – If the work was necessary then the OC had an obligation to proceed with the work. Space for 50 cars would be difficult to find! Though it may be unpleasant to live with for the next 4 months it is, after all, only 4 months. Extra patience and tolerance may be required over this time.

            If you believe that safety is an issue then you should put your concerns and suggestions in writing. Perhaps some additional signage would be beneficial? 

            As PeterC suggested the common property lawn rejuvenation would probably be part of the overall project cost. This should be on record either via the committee Minutes or the General Meeting Minutes. Why don’t you ask the strata manager to check?
