Hi, just a question and thought this forum may be the place to ask?!?!

We have owned our property in a strata non-gated community for over 4 years now, never have we used any of the facilities or benefits of the estate – I think we purchased the property without really looking at the inclusions – the non strata border is at the footpath outside our property, parks across the street zoned as council not under the body corporate.

Have probably not worded any of the above correctly, but I am interested in investigating if the property can be zoned out of the strata, what would be involved where we would start?

Have seen various things over the years of people declaring their properties kingdoms etc – do not want to go that far, love our house but the community management side of it has me ready to sell.

As mentioned, not a gated community and we are at the boundary of the estate.

        Not at all simple.

What you own is effectively a share in all the common property.  It is not the same as owning the piece of dirt your house sits on.

Have a look at the topics related to the sale of common property.

You own a share in the entire property coupled to a special licence for exclusive use of one of the lots. To secede from the property, the entire strata plan would have to be drawn up again and unit entitlements reassessed and to do that requires a high threshold resolution of a general meeting, with details varying between jurisdictions.

When you buy into a strata-titled property, you become a member of a club, whether you like it or not.

Also if you wanted to do all that, i.e. rearrange all the legal entitlements and create your own property title, you would have to meet all the costs which would be considerable.
