      Hi Everyone

      Can you clarify what temperature a pool is maintained for your building during Summer and Winter and the rationale please? i.e how is it determined and whether owners make permanent changes at an AGM.

      I live in a development where the pool was heated all year to a temperature of 27c. At the last AGM owners agreed to the pool not being heated in Winter as a cost saving exercise. There was no resolution that the pool would otherwise be maintained at another temperature during Summer.

      The EC has made a decsion to lower the temperature to 24c. The pool does not enjoy sun all day and its a large pool… frankly it’s freezing and unless one laps its quite uncomfortable. 

      I would appreciate your comments

        I’m unaware of any mandated temperature for heated swimming pools, but as 27°-29° appears to be the optimum setting on the heater thermostats, I assume that’s the “ideal”.

        With regard to your Owners Corporation’s decision not to heat the pool, that amounts to a decision not to maintain an item of its Common Property, and whilst such a resolution is permissible (in NSW) it requires a Special Resolution, where ≥75% of those Owners present in person or by proxy at the AGM need to vote in favour, and where that percentage is calculated from the unit entitlement those Owners’ Lots / the aggregate unit entitlement for the Plan.

        So IF the resolution taken at your AGM was passed by a simple majority and with that level of support correctly calculated then it’s been properly taken, and obviously if the converse applies the resolution cannot be enforced and could be invalidated.

          Heating a very large pool could be a very substantial expense. I’m not sure that failing to maintain a particular temperature could be called failing to maintain the common property. Not fixing a leak would be. Does the pool have a pool blanket to help retain heat when not in use? Do you have solar heating to help reduce costs? Perhaps those concerned about the maintenance costs would be happy to spend some money if it would lead to long term savings? What about proposing such measures to an AGM and then everyone might have their cake and eat it?

            I don’t wish to perpetuate this thread as justsaying has enough to consider, but I took the line that not heating a pool is like not cutting the grass; both are decisions by an Owners Corporation not to adequately maintain its Common Property. As always, just my opinion!

              Thank you for your comments. To clarify, owners agreed to the motion to stop heating the pool between Winter months. I have no issue with this as it was on the agenda for debate.  There was no amendment regarding the reduction of the pool temperature. The EC simply took this decision although the previous year the full motion regarding the swimming pool included the temperature lowering was defeated.

              I question if the EC has a mandate to change the temperature  of a swimming pool without notice and approval.

              It also  seems to me that an EC can make changes to a scheme IF an item is included in a budget…. TRUE or FALSE?
