I live in a strata plan that has been dealing with a home owners warranty insurance claim for more than five years. The builder went into liquidation just as the building was completed. Purchasers settled with the developer and moved in. When the drought broke we found we had faulty water proof membranes and a wet building. We engaged a solicitor, undertook forensic investigations, had reports written, hired a consulting engineer to prepare scopes, invited tenders and now hvae builders on site undertaking works. The insurer was unreasonable and it took years and cost a lot to have them accept virtually all the elements of the claim. Since work began further issues have emerged. I would like to connect to other strata plans that have had or are having the same battles. Hopefully we can help each other. One of my missions out of this experience is to pursue changes to building supervision laws (especially private certification aspects) and also the home owners warranty legislation. I look forward to hearing from others interested in this area.
