      All roles of the EC have been delegated to the strata manager. Prior to the last AGM the EC gave the manager instructions in writing to amend one of the standard motions. He wrote and distributed the agenda without the amendment and when this was brought to his attention he advised it could be changed during the meeting which it was. However he wrote and distributed the minutes which didn’t reflect the new motion and the fact that the meeting carried it and so we now need an EGM to correct them.

      With a review of the management agreement underway I would prefer the OC agree to change managers but fear that it would be very difficult to get the OC to agree. Would it be prudent, if we go ahead with the new management agreement, not to delegate EC roles to the manager? And how much extra work would that create for the EC?

        ozzietars – before your post disappears of the bottom of the list, I’ll offer this response.

        Provided whatever was resolved with regard to the amended Motion is being actioned, then there’s no need for a EGM to correct the Minutes – just wait until the next planned General Meeting (e.g. AGM) and when the obligatory Motion about accepting or otherwise the Minutes of the last Meeting comes up, don’t accept, and instead amend them at that time.

        Re the Agency Agreement, unless you have a very active, committed, and strata-savvy E/C it’s a lot of work!

        So depending upon your Owners Corporstion’s preferences I would leave all delegations except perhaps the ones about approving quotations and the payment of invoices, with the Strata Manager because notwithstanding the remaining delegations in the Agreement, Members of the E/C such as the Secretary still retain their roles under the Act, and can exercise those to effectively overrule the Strata Manager when circumstances so dictate.

          Thanks very much for that advice – and for this forum which is so very helpful during this difficult time we’re having.

          As the motion, as passed at the AGM, was not actioned I obviously have a lot of concern about our ongoing relationship with the SM. His inaction on the issue can only benefit him.

          He is now, incorrectly, saying he did not receive written instructions from the EC on the issue which was the subject of the motion at the AGM.  I have written a detailed history of this issue and the EC plans to discuss it with him next week. We are trying so very hard to keep good relations with him mostly because the rest of the OC are very loyal to him even though they constantly criticise him.

          It’s crucial that I don’t fall out with either the EC or the OC while at the same time fulfilling my duties on the EC but we’re all finding it hard going. Thanks again for your advice and help

            ozzietars – as each of your different posts relate to the one core issue of the Strata Manager, more succinct responses may result all the issues were raised by posts to the one topic / thread.

                No problem ozzie, I’m no terminology expert either when it comes to on-line forums (or is that foruma), but I was just suggesting you put all your issues with the Strata Manager and their Agency Agreement in the one post, or even after replies re one or the other, instead of in different / multiple posts, albethey all under “The Professionals”.

                Hope that didn’t confuse you; because it did me!
