      can someone please let me know who is responsible for the excess when a claim is recognised and paid for by the building indurance.

      is the excess responsibility of the lot owner or the OC?

        Hi there, Others may know more.  But you may need to add a little context and meaning, that is, do you find yourself as an owner having to pay any excess?

        If it helps, in my experience, if a claim as you say, is recognised and paid out, the excess is automatically deducted from the insurer’s payment to the insured.  If I’ve got this ‘right’ wouldn’t the excess amount be absorbed within  the payment by the insurer back to the OC as the insured?  Is that coherent in a solution to the situation as you describe?

          No, it is not me, it is an another owner, whose kitchen cupboards were damaged by water penetration through the common property.

          The building insurance is paying for the damage of the cupboards. Some SC members are against for the insurance excess to be paid by the OC and they are asking the owner to cover the insurance excess herself.

          They are referring to SSMA 2015, Division 1- Common property, section 5.

          Until now, all the insurance claims by other owners, the excess was paid.
