    Hello,

    I live in a unit of 6 flats that are all rented out.

    The landlord of one or all of the units comes along every week to do gardening.

    Do we require notice of the landlord attending to the common property?

    She fills one of the bins up with the off cuts of her gardening, reducing the tenants ability to properly utilise the bins so we get overflow issues. If she hired a gardener, they would take the clippings away as part of the service.

    She also leaves the security doors open, given we had one unit robbed recently and the security doors say ‘please leave the door closed’ I’m a bit irritated by the lack of regard for the tenants security.

    Does she have the right to use the bins for gardening?

      Strictly speaking the bins are for the use of residents, but isn’t the absent Owner/Landlord doing you all a favour by keeping the Common Property in a state of good repair?

      If the Owners Corporation (O/C) did as you suggest and engaged the services of a gardener, then sure they’d take the green waste away, the O/C and indirectly all Owners / Landlords would pay for that service, and you’d all see that increase in their Strata Levies reflected in your rent/s.

      As an Owner, your unofficial “gardener” doesn’t need residents’ permission to be on Common Areas, but why not place a polite and personalised note on the bins and on the security door thanking her for the work that she does, and asking her to perhaps spread the green waste amongst all the bins so that residents can more easily compact it and to remind her of the need to keep the security door closed?

        Where is Steiger based?  My local council in Sydney’s east provides green-lidded bins for garden waste and also encourages residents to discard vegetable peelings, fruit cores and other kitchen waste via this route.  Garden waste would not be welcomed in the regular red-lidded bins.  Can Steiger ask for a green-lidded bin to be provided for his/her building?
