    Hi everyone,

I’m not sure what I should do about this situation. We’ve recently had some new neighbours move in within the last fortnight. The problem we’ve been having is that they smoke marijuana inside their apartment but the smoke and smell wafts out into the foyer area and into our apartment and another neighbours’ apartment.

We’re not sure if we should ask them directly to try and keep the smoke/smell contained, if we should report it to strata, or report them to the non-emergency police line.

What would be the best thing to do?

    Thanks for your help.

I don’t care what people do in their own homes, but I do hate the smell of marijuana smoke, it makes me feel really nauseous and it is very pervasive.

Contacting the police is pretty extreme, and on one analysis a bit of a waste of police time.

There is quite a bit of debate about smoking generally and smoke drifting into other lots and common areas.  There was a case in a NSW tribunal that held that smoking by a couple in a unit was causing a nuisance to people in other lots.

I suggest you start by speaking to the neighbours first and if that doesn’t work try the strata.

The answer is pretty simple I would have thought.  Wait until they have been smoking for a while – then knock really loudly on the door.  When they open it – red-eyed and slightly paranoid, calmly introduce yourself and let them know that recently the cops have been targeting dope smokers in the Mosman area – check the Mosman Daily crime round-up for details – they are always busting kids down at Clifton Gardens and being a good neighbour and all you just thought you would warn them.  Then wish them all the best and excuse yourself.  I doubt you will smell them after that.  Cool
