I own a unit in a multi-story inner city block. Recently I was informed I would need to replace the air-conditioning unit in my unit, as the AC technician (paid for by building or strata management) advised this was needed (my AC unit was not working effectively). I was told by the agent renting the property out for me that this was probably caused by water not getting through the line. I took this up with the building manager, who indicated that no one else was experiencing this problem. I went ahead and replaced my AC, but now learn from the recent minutes forwarded to me by my agent that quite a few other unit owners were experiencing the same problem. I would think I should not have had to pay for my AC's replacement given this was due to its not receiving adequate water flow through the (common property) pipes. I welcome advice.

      Hi Alanp

There is a threshold issue. Is the AC unit lot or common property?

If common property, then the OC was required to fix it if it was defective.

If lot property and the AC unit repairs can be categorised as loss incurred by you arising from a failure of the OC to maintain or repair common property, then the OC was responsible for the cost of repair.

If lot property and the AC unit repairs cannot be so categorised, then you are liable for the repair of the AC unit.

Let me know if you have any questions.
