      We had an EGM called by some members of the EC to re-appoint the current Strata Manager.  Others, and I, are not happy with this SM and have been pushing to replace this firm.  At the AGM she informed us that her partnership had been dissolved and she would be operating under a new name.

      I contacted OFT and this forum and both advised no-can do and that a change of agent had to be an Agenda Item for OC to vote.

      We had an EC meeting and agreed to go to tender for a new SM and when quotes etc had been received an EGM was to be called to decide from the tenders who to appoint as SM.  This did not happen since some members of the EC want this agent and went ahead and called an EGM.  There was only one motion on the agenda and that was to appoint this agent again.  

      Included in the Agenda was her contract (terms).  This document was 3 pages in total.  I had a copy of her original contract, 7 pages long.  The ‘missing’ pages included the costs she would charge us and the terms.  Another EGM has been scheduled for early next year but I really want this person gone because of her incompetence and lack of integrity.  The trouble is she has 4 owners on her side – they are her friends.  There were  a number of owners present at this meeting and horrified at her behaviour because even though she only presented 3 pages of a 7 page document she tried to continue the meeting.

      We now have this dodgy agent until early next year.  How can we (the like minded owners) get rid of her when the secretary is her friend and we are often bulldozed and bullied by them doing what they please.  Sadly most owners are apathetic in these matters but we do have a few who can see her for what she is but we can’t seem to get this agent out and a new one in.  Advice please???  Should we go to CTTT and get them to appoint a new agent?  We did get some very professional tenders and I would like to interview those agents.  The EC has 7 members, 2 of us want a change, 4 want to keep the dodgy agent and 1 runs with the fox and hunts with the hound!  If a few like minded owners organise for the CTTT to appoint a new agent what would be the downfall (if any).  I really need sound advice on this predicament!

        It’s the vote at the EGM that is important. You should have voted down the motion and as you didn’t it looks to me like you don’t have the numbers and so their is little you can do unless they (EC or SM) take action that are in serious breach of the act.
