      I’ve been trying to get our SM to include in the minutes or Agenda of the AGM a summary of the owners who are owing money and the penality interest they have accumalated.

      The SM are very reluctant to do this but I believe all owners should be aware of the debits owing to the Strata.

      Could this be due to privacy concerns and do the owers have a right to know who owes debits.

      We don’t have a major problem at the mo but I’d like to keep it that way and naming and shameing the offenders might fix it.

        There is no problem with doing that, and the most appropriate place for that is in the financials – that is where we do it.

        Otherwise to that extent the financials aren’t complete, you need to know the levies in arrears and who has not paid, just as you need to know any other debts owed to the OC.  It isn’t a privacy issue.

          Our routine financial statements list each unit in arrears and the amount but only by unit number, not by name. We also list each unit not in arrears and the amount by which they are in credit. 

          The budget figures include the total amount received as arrears penalties but not listed by unit numbers.

            On every levy notice, all owners in arrears should be listed with the amount owing.  That’s the way to do it.

            There are no Privacy Act breeched.  Every owner has a right to know. 

            The Privacy Act is often used as an excuse for not disclosing information to concerned parties.  Often incorrectly.   I was once refused the contact details of my tenant by my managing agent who stated that the Privacy Act prevented her from giving them to me!

              Thanks for the info.

              Yes it is on the financial report but it just says

              levies in arrears $xxx

              I’ve asked for it to detail which lots are in arrears but get no response.
