We have a situation where one lot has gone to an EGM stating that they only wanted to change fixtures and fittings in their bathroom renovation but have gone and added an extra bathroom, drilled into the slab, caused water damage and structual damage to the lot below.
I’m wondering what are the powers of NCAT? Can they force a lot owner to undo the works that are done? ie can you force someone to take out a bathroom that has been added in a new location within the lot illegally?
we are off to NCAT shortly for our hearing and I’m trying to find cases
Otherwise it seems you can just do what you like and pay a small fine and move on which seems a little unfair to the owners corporation
