Hi,
I am the owner/occupier of a factory in Sydney. There are 9 other factories in our strata-lot.
Last year, we had some rain that got into about 4 of the factories, including mine. Some quotes were obtained, and some of the cheaper work was done, but not all of it due to the penny-pinching nature of the executive committee of the strata – note: I am on the committee and did want the work carried out but was over-ruled.
2 weeks ago Sydney experiences major rain and our factory got damaged. I’ve lost over $5000 so far in damaged property and that is growing with more repairs to our internal office ceiling.
And again, even now, the other members on the committee are refusing to replace the box gutters above my factory, arguing that we haven’t go the money, and that the gutters just need cleaning of all leaves.
My questions are these:
* how do I force the repairs to my factory so that the roof and gutters are repaired?
* I am tempted to threaten the strata with a damages bill, given that they knew the box gutters were bad (advised previously in writing by a roofer). I don’t want to go through with it, but if they dig their heels in, can I call their bluff?
