    Hi i bought a unit in nsw/qld border 7 years ago it had a pergola erected on it years before 

    i In the last year or so bought up at a extra ordinary general merting that I would be doing repairs which 4 people at the meeting agreed too i started the repairs but found the pergola so rotten i replaced the structor at my own expense 

    the secretry of the building told me that I did not mention anything of  anything of the sort about improving the pergola and asked me to cease work i did not do so and finished the job at hand 

    so outcome now is we went to mediation which in the end i found out she was not happy with the outcome so she then sent to ccct for further appraisal and now they want me to pull the pergola down please give me some advise 

    anything i ask for is always  NO as she had a gripe with me about mother being a tenant in this unit and needed to move so i could move in

      If the pergola is on common property (as opposed to lot property) it doesn’t belong to you and so the strata can remove it if an EC or AGM votes to do so by a simple majority vote. They can also charge you for any costs involved in removeing the pergola if you refuse.

      Are you sure it is on common property, have a look at the plans for when you bought the property which should show lot property and common property.

      Also check the bylaws to make sure their is not an exclusive use bylaw referring to the pergola.
