      Two questions:

      Does the EC have the authority to remove a privet from the common property which has grown quite large over the years and was a leftover on the property when the building was constructed.?

      Certain times of the year this tree causes asthma and bronchial problems to some residents.

      My understanding is we don’t need Council approval to remove a privet.

      Some EC members think it has to go to a EGM but others think the EC has the authority to remove the privet.

      If removed, something would probably replace it.

      We are in NSW.

      Please advise.

       

      The other question is where can we find the proposed info for putting locks on apartment windows to try to prevent children from falling out.

      We realise it’s to come up in the new Strata laws.

      Our building is about to have the windows and doors refurbished and it would be good to know what may be required so we could do it all at once.

      Jimmy has probably presented it but we don’t know where to find it.

        Felix – in response to the removal of the noxious weed (privet), provided the work is covered by and within an item of approved expenditure such as “grounds maintenance” the Executive Committee can authorise the works in order to ensure the O/C’s compliance with the Law [specifically the NSW Noxious Weeds Act (1993)]even though, technically speaking, that’s a change to the common property.
