Hi,
I am an owner and EC member of a townhouse in a group of 6. I do not live there and had a tenant until recently. The electronic gate covering the driveway was damaged and so repairs were made by the SM. I was told a date the gate would be repaired, but noticed the gate was still open a week later. Got a message from the SM that the gate would be turned back on the next day and that the delay was due to needing to reprogram/replace remotes. I sent an email asking for clarification as I was not contacted at all regarding the need to reprogram/replace remotes and I had one in my possession (as owner), there are 2 per townhouse.
I was told my tenant was contacted and their remote reprogrammed. I went and tried mine and it doesn’t work. I emailed them as I could not access my own property (now empty) and demanded they remedy the situation. They are refusing to respond.
I made a formal complaint to the Principal of the Real Estate Agency who employs the SM. Again no response. I stated that it is the responsibility of the SM to ensure that once the repairs were completed all owners/tenants access should have been checked before the gate was activated. Since mine does not they have been negligent in their duties (they did not contact me, they will not tell me exactly was done and they have not provided contact details of the company that did the repairs/reprogramming).
How do I legally get access to my property? Surely it is illegal for a SM to change the gate access , not advise me as an owner, not care if all parties can open the gate and then when mine doesn’t work simply ignore me? Do I contact the police?
