In the courtyard of my townhouse I have large gum tree that is shedding its limbs from a height in excess of ten meters.

I have approached the strata managers and I have been informed that I will need to apply to the council to have the tree removed.  I was also informed  that the first 2.7m of the tree is mine and that all above that is the responsibility of the strata.  I am also required to pay for 50% of the removal. Is this correct?

The trees were originally planted as part of the gardening design when we purchased the town house.

The tree is proving dangerous and I fear for my twin 2 y.o. twin grandsons and cannot allow them to playin the garden.

Is the strata manager correct in this matter?

We were given the same info regarding trees in courtyards.  The owners corp paid to remove dangerous high branches from trees and where a whole tree has been removed, the owner and OC went halves.  Of course all done with council approval!
