    Hi,

    I have repairs needed on my unit/townhouse and have advised the real estate several time but they keep saying strata need to do it and they can't make them. One is a sliding door that doesn't shut fully which was looked at over a year ago and nothing done. Rain gets through and is causing constant mould growth even the gap being plugged as best as possible with towels. Another is rain leaking into the house through something to do with water drainage from an upstairs balcony.

    The real estate seems genuine but having issues with them dragging feet before it is hard to tell. Strata are known to be useless by most of the tenants having power to hot water out for over a week at one point and having a separate leak from a shower into down stairs taking over a year to get fixed. I had made what noise I thought I could and just want to know who needs to do what and make them do it so I am not just annoying the wrong people.

      Have you or the real estate agent contacted the owner?  If I was the owner I would not be happy if there was an outstanding issue affecting a property I owned. 

      If your door doesn't shut properly it would be a security issue.  If it were me, I would write not only stating the water/moisture/mould and possible damage to property (and health) but also I would want to know who to hold accountable should my place be broken into because of a broken door.

        The key issue is that the Owners Corporation has an absolute legal responsibility to fix common property – no limits and no exceptions. Your rental agent should know this.

        You can either take your landlord to Fair Trading and get an order forcing them to demand that the Owners Corp fixes Common Property – that will cost about $35.

        Or you can take the Owners Corp to the CTTT yourself, which costs about $75 but at least you’re cutting out the middle man.

        Call Fair Trading on 13 32 20 to get the ball rolling.

        They are useless, go to the owners meeting yourself note that may have a different agent again. Give them by hand or pot invoice costs for repairs and fair warning. As a landlord often very lax agents do nothing as they always win and there are no sanctions on them.
