    I want to replace my balcony doors (which are currently sliders) with bi-folds. From reading posts in this forum I presume I need to create a Special resolution that allows me either exclusive use, or allows me to modify common property. Is that right?

     

    We have had some waterproofing issues around the doors and I am a little worried about taking over maintenance (esp as the water is probably coming in under the floor)

     

    Anyone have any experience around this ??

      Yes you would need  permission and that may include a by-law.  And this would mean you were responsible for the ongoing maintenance of this area.  If this system wasn’t in place, people would be knocking holes in walls and complaining to EC to fix the collapsing roof. 

      One of the reasons people live in strata is the knowledge that the exterior is taken care of by the OC.  Yes, it’s a pain we can’t do what we want.  But then again the outside (and structure of a building) is usually the most expensive when it comes to maintenance. 

      We can’t ask for what we want and then expect others to pay for the upkeep.  I don’t mind if someone wants a change, but let that be on their head – and from their wallet.

      1st question to ask is when was the strata plan registered for the building that you are in. 2nd question to ask is whether the balcony door is yours already.

      In strata plans that were registered under the original Strata Act, in the 1960’s, the balcony door wall window structure is not common property as such. In the 1973 act, it depends on how the strata plan was drawn as to whether it is or isn’t common property.

      I would have to suggest that if you are looking at replacing the door you would want to make sure that the sealing of this structure is done correctly and or that you get the correct warranties from the contractors on completing the work.

      If the door is common property the correct process would involve getting approval by a special resolution and exclusive use by-law.
