    Hello,

    I’ve been toiling with our Strata Managers for years and well.. quite frankly..i’ve had enough of their poor performance.

    I’m the ONLY member of the executive committee because no-one else gives a dam (or even lives in the small complex of 8), so the question is:

    Can i call an emergency general meeting (with myself) and terminate the current Strata Managers?

    I know this is normally done at an agm, but no-one goes to the agm.

      Your Executive Committee meetings must be interesting!

      I don’t think you can call a GM, because you won’t have a quorum if only you attend.

      In the circumstances, it might be an option for you to find another strata manager, and then apply to the CTTT for an order for a compulsory strata manager.  It sounds like you have a basis for saying that the OC isn’t functioning satisfactorily.

      The block has essentially turned into a slum because the tenants dont care (nor should they i suppose), the other owners live interstate and the SM cant be stuffed :-(

        Hi Worrywort, just an unsolicited suggestion. Have you thought of getting the phone contact details of the other owners.  It may be that the other owners don’t know how badly their assets are deteriorating.

        I often find a phone call if better received than a piece of paper. Also it might be a situation where asking for their proxies is a good idea.

          Aha – but if Worrywort sends out the agenda and holds the meeting at the appointed time and there is no quorum within half an hour he just needs to turn up at the same place a week later and whoever is there is the quorum.

          The first thing he then needs to do is reduce the size of the EC to one and then pass all the motions he wants.

          Just wait till he starts raising levies and fixing the building up, though – then you’ll see attendances at meeting shoot up.

          This is what the Act says:

          12   Quorum

          (4)  If a quorum … is not present within the next half-hour after the relevant motion or business arises for consideration at the meeting, the meeting stands adjourned for at least 7 days.

          (5)  If a quorum… is not present within the next half-hour after the time fixed for the adjourned meeting, the persons present personally or by duly appointed proxy and entitled to vote constitute a quorum for considering that motion or business.

          I’ve tried numerious times asking SM for the details of the other owners, but each and every time they ignore the question. I’ve even asked to speak with the SM owner, and alas… i’m just ignored :-(

          Given that i am the sole person on the EC, this seems a plausible idea :-)
