Hi i have a small problem that could have escalated to an unlawful eviction
ill start off by saying there are 21 units in a multi storey building and the strata manager is [Name removed for legal reasons] ( the building is surrounded by 7 camera’s recording 24/7 ) on tuesday the 6th may a new tenant was moving into the unit block and they deliberately blocked off the only entrance to the whole unit block , meaning no one can enter or leave the property
I was coming back into the unit block to park my vehicle – these people where asked to move and they refused calling us all sorts of derogatory terms ( they are workers from [Name removed] ) so i told them not so nicely to f off or i will call the police and have them removed.
The workers just kept on going insulting myself and my other friends with me. One of the workers advised me in not so nice terms to phone his boss – so i did, his boss has then turned around and phoned my strata manager and made a compliant that i was violent took my shirt off and was waving it around like a mad man in threatening manner.
Now here is the kicker – the strata manager has phone my real estate making a serious allegation of violent conduct on my behalf – at no stage before or after making this vexatious vindictive complaint did the strata manager bother to check the video camera they just assumed the new tenant (who so happens to be an owner) was correct and honest. The lady in this unit is unaware of the cameras as was the removalists (on the phone these are horrible nasty people) but the strata manager is very much aware of these cameras yet chose to ignore them and make this complaint anyway.
I would like to know what are my legal options to this (it is not the first time this strata manager has made vexatious complaints against this tenancy , the only difference is this time i have video footage vindicating myself , it actually shows the removalists harassing us not the other way around).
I believe the strata manager had a duty of care to view the camera footage before making a complaint of such a serious nature considering the potential outcome if proven correct
Both the strata manager and removalists have made a serious unsubstantiated criminal complaint that can be easily refuted just by looking at the 5 mins of video footage
All this also happened while the removalists were not even on common property They where outside of our boundary on the other side of the fence at the end of the public road completely blocking anyone from entering or leaving for several hours.
I would also like to know what action can be taken against this new lady owner who was unaware of the camera and lied about the whole indecent – that is going to create an uncomfortable situation through no fault of anyone but her own (directly below this unit).
An email has been sent to the strata manager outlining my concerns and putting forth our side of the problem. In it I have told them they behaved in an unprofessional unethical discriminatory fashion bordering on criminal considering all they had to do was view the video ( their office is less than 1km away from this building they could have walked its that close).
I am yet to hear a response (not surprising as it was only sent yesterday the 7/5/14 ) – these people can not continue to get away with this type of behaviour.
