    Hi

    Recently moving into what’s supposed to be a new development, I’ve encountered some seriously damaged tiles. This issue is affecting many (but not all) within the complex and our strata manager has advised that these tiles are common property. This issue has been raised a number of times with our Executive Committee who fail to take any action on anyone’s behalf and who have even wrongly claimed that all items within a person’s unit are their responsibility. And that the Executive Committee can’t do anything about it because it’s not a structural issue. Our strata manager does not want to get involved and has just passed the issue across to the Executive Committee who continue to do nothing. We are all stuck in not being able to arrange to fix our tiles ourselves because they are common property nor having our supposed Owners Corporation representatives arranging for anything to be done on our behalf. I’d be interested to hear any suggestions you may have on what can be done.

      Well if you can get 25% of the owners to support an EGM you can submit a motion for the tiles to be replaces which just requires a simple majority at the EGM.

      The SM works for the OC and so cannot make any decisions so don’t blame them, but they should assist you in organizing an EGM explaining how to do it.

      Once you can show the SM you have the support of 25% of the Strata get the SM to obtain quotes for the repair (or obtain them yourself) of ALL the broken tiles (so long as they are common property and sep individual quotes for any that belong to the lots) and have this included as a motion on the Agenda for the EGM.
