Im hoping someone here can shed some light on these issues for me please:

We own a ground floor unit and along the side of the property, along the fence, the trees have grown so high, some to the height of the 3 storey complex. We now no longer get any sunshine into our living room or bedroom and need to have the lights on almost all day.

Should trees be kept at fence height to avoid this very problem? My instinct tells me they should. Am i right?

I rang strata to ask what the procedure is with the maintenace of trees and they basically told me that if they are doing no harm they wont do anything.

I then put my request in writing and was advised to leave it with them and that they would get back to me as soon as possible. Thing is, they are very slow at getting back to me and getting anything done.

I put in another request 7 weeks ago re: the state of the common garedn patch directly in front of our unit and also about the rubbish of branches, etc that are thrown down the side of our unit. They replied in about a week, that they would get some one to look at this. NOTHING HAS YET BEEN DONE after 6 weeks they said ok.

All these strata issues are affecting the sale of my unit. Everyone that comes through loves the unit but complain about the rubbish i asked strata to clean 7 weeks ago and also about there being no sun light!

Where do i stand? Please can someone help!

PS: Is it acceptable that strata are taking so long to get things done?Frown

Anything about trees is subject to each individual councils rules and regulations.  I don't think there would be a limit to height.  Our complex is surrounded by trees – some three or four storeys high!

Perhaps you could go the damage route.  Approach your council re overhanging branches?  Dropped leaves causing a slip hazard?  Lack of light resulting in damp? The roots of the trees – potential for causing damage to foundations/plumbing?

We have had residents in our complex approach our council themselves then bring the council permission to the EC/OC for their consideration.

Don't know if the EC/OC have to clear things up (branches etc) but I know if it were my place on the market, I would do a bit of raking and sweeping myself.   And don't forget, having trees around can be a plus – especially when one is living in a built up area.

Hi Mara, trimming of large trees rely on council approval even if they are on your property so you will need to request the strata manager or EC to apply to council for permission to have trees trimmed. And there is a fee. In my experience this may take some weeks and is best if you request a site inspection. Often council do not approve of trimming unless you can prove that limbs etc are within so many metres of your property or causing severe nuisance. You can check your councils website for info.

In regards to the rubbish, yes the OC should deal with this but if I was selling my unit I would probably just clean it up myself!

      GOOD LUCK !Smile
