Help! I’m scheduled to enter the Fair Trading mediation process in November to (hopefully) force my tardy/apathetic executive committee to replant the trees that were chopped down, ostensibly to unblock drains.
Now I’ve just discovered our strata management company seems to have gone out of business.
I’ve sent a hurried email to Fair Trading’s officer handling the mediation asking what we should be doing but has anyone one else faced this kind of thing ?
Very grateful for any thoughts, opinions. I’m in Sydney.

Looks like your committee has a problem.

As I understand, your application to Fair Trading named the committee as respondent. So they have to deal with the mediation even if there is no strata manager.

However the legal system is not that unfair. The committee could ask for a time extension because there is no strata manager. FT could then assess the urgency of your application and what disadvantage the committee would suffer prior to making a decision about an extension.

Youll have to bide your time.
