Thank you, for that very interesting article, here in Victoria we are seeing an increase in build-to-rent apartments, perhaps an article on the pros and cons on this would be interesting, especially for older people who could live comfortably without the problem of strata issues.
Here we go again, I don’t want to sound precious but why use another headline attacking Victoria and ending with “Could this happen in NSW? Yes, probably. Would the developer get away with it? I very much doubt if the new block would avoid the kind of forensic scrutiny that would put them out of business” The scrutiny applied to your “new development” wouldn’t help the poor owners of the original property, by the way, there are another four states and territories you might complain about, good luck with your new book I will look out for it at the Hill of Content.
In Victoria. I’m not sure what your problem with Victoria is but going by the act you have quoted it’s straightforward and achievable.
Thanks for your editorial on Victoria’s strata laws which are certainly in need of attention from the Parliament, as for the problems at VCAT I understand that it is being tackled by the Attorney General as a priority and only time will tell if this is solved, I suppose it will mean more lawyers.I’m still trying to remember the last time we had a riot in the city, demonstrations outside Parliament are a Melbourne tradition, we seem to have a tram-stopping march in front of the State Library or Parliament each Saturday, but as the old saying goes a demo doth not make a riot.Please keep up the good work.Thanks for “rave” as a Victorian owner and chair of our Committee of Management I hear you loud and clear, always look forward to your emails, and now you are looking south I hope to contribute and seek advice from you and other readers.
I’m in Victoria, our strata has an interesting case which I will share with you, one of our units owes around $20K to the OC which includes repairs we undertook in the apartment to stop sewage flowing into our common area, the tenant maintains she has an interest in the property but can’t prove it, the bank that hold holds the mortgage is reluctant to proceed with a sale of the property and the mortgagees have declared bankruptcy, our strata raises $140K per year so the debt is a problem, COM has tried through our solicitors to contact the bank to no avail.
I’m a Chairman of a Committee of Management in Victoria, all owners are invited to an Anual General Meeting and are invited to be a member of the owner’s committee, there is a limit on the number of owners who can sit on the committee, I suggest you attend the AGM and put yourself up for the committee, it’s not a hard process.
Storing items in common property means that they have been dumped and can be removed or as in our building they as are classed as a fire escape hazard and removed!
