Update: I’ve spoken to my brother who works in the AFP and he has suggested that unfortunately, the police does not have much power in these circumstances especially when Unit 1’s occupant is the Owner’s son therefore Strata cannot evict nor can the police for that matter.
I did try to speak to the occupant and his “mates” were present whilst I was doing so and all they did was just laugh and suggest that they try to break the record of the 300+ complaints over the last year or so – very helpful indeed.
I think the only way out is for all the owners to sell and just lose their investments…there’s no other way out!
This anzac long weekend will be a good test to see how bad the noise/partying/music/mess/garage blocking/chaos gets.
Thanks for the tip about contacting Council – I’ve just done so this week and now waiting on Hornsby council to advise whether we have enough to go on to issue a noise abatement order. Pity they won’t be able to do anything else about blocking our garages or creating a threatening environment to live in.
The owners/other tenants have consolidated a spreadsheet of incidents/complaints against Unit 1 and since 1 April 2012, we now have over 300+ separate incidents/complaints!!
We are going to call the police each and every time they break the law but I don’t know if that’ll stop them…
Update: its been difficult for the other owners to take videos recently because whenever they attempt to do so either from their balcony or from the common areas such as in front of garages, Unit 1’s son and his friends stare them down and threaten with their body language and words such as “yeah? think you’re going to record us? do it we dare you” and start to walk towards them so they get scared.
How do we collate hard evidence for the media if we’re constantly fear leaving our units???
Thank you so much for the advice!
I am currently collecting all the photos/videos/paperwork necessary. I am also gathering consent from the other owners to be interviewed formally by A Current Affair. They returned my call this morning advising they are definitely interested in my story as long as:
1. All the owners are willing to be formally interviewed
2. We send in all the hard proof evidence
In the meantime, I will look into the Noise Abatement Order and see what it can do for us!
Thank you so much
p.s. did I mention the irony that the owner of Unit 1 actualy owns a Real Estate agency of his own in the local area…and to think someone as professional as him is allowing his own son to impede other peoples lives.
