      I’m looking for some clarification with the new Strata Laws in relation to lot owners and SC positions. 

      Can co-owners be on the SC at the same time?  One owner putting their hand up on behalf of their ‘owned’ lot and the other owner nominated by someone else in the building (who is not wanting to be on the committee)?

      I am being told ‘no’ but I feel this puts co-owners at a disadvantage to people who share/live in the same unit but only one person from the relationship is the actual owner.  I have been led to believe in this instance, the owner could be on the SC and their partner/wife/husband could also be elected as a ‘non-owner’ put forward by another lot owner in the building (who is not on the committee). 

      Would love some advice/help on this issue.  Thank you.

        It’s all about who nominated whom. Both members of the couple would have to have been nominated by a third party.

        A co-owner can’t nominate themselves – they have to be nominated by the other co-owner or another owner, provided neither they nor the third-party nominee is standing for election.

        So who nominated the first co-owner? If the nomination was invalid (and they are supposed to be done in writing) the wrongly nominated person should step down.

        I have to add, however, that they could then be co-opted back on to the committee, by a majority vote of the remaining committee members, to fill the vacancy created by their resignation.

        The question then becomes, how much trouble do you want to cause, bearing in mind that any decisions made by the committee are still valid until the discrepancy is reported?

        This is who the Act says can be elected:

        … an individual who is a co-owner of a lot … if the person is 
        nominated for election by an owner who is not a co-owner of the lot or by a co-owner of the lot who is not a candidate for election as a member.

          Thank you Jimmy, really appreciate the response. 

          We have our AGM coming up shortly and we are being told that only one owner (from each lot that has two co-owners) can be on the committee at the one time.  We are told this change is ‘new’ to the new strata laws, but i can’t find any reference to this on Fair Trading. 

          I’m a sole owner, not a co-owner so this doesn’t affect me personally.  

          However, our building have a fabulous community orientated husband/wife couple as part of our current SC.  It seems a shame that when you have people who are willing to invest much personal time to help the rest of the community, that as a building we were being told that only one could put their name forward.  

          It’s great to know, that they can both be on the committee again as long as they both have third party nominations.

            Sorry, my mistake. I was so hung up on the nominations that I missed the obvious.

            Two co-owners of the same property can’t be on the committee unless they also own another lot in the scheme.

            So the advice you were given is correct.  This is what the Act says:

            Only one co-owner (including a company nominee of a co-owner) of the same lot may be a member of a strata committee at the same time …

              Thanks again, really appreciate the help.

              It seems somewhat unfair, that if a couple are co-owners, only one of them can be on the committee.

              But….  if there is only one registered owner, then both members of the couple can be on the committee (admittedly with one being put forward by another owner).
