Hello, we vacated a premises over a month ago and we are still waiting to have our bond returned for various reasons, one of those being the PM claims that we are 15 days behind in rent.
We asked for a copy of the rent ledger, which was provided with some GLARING problems. Firstly, we are not 15 days behind in rent, secondly in at least one instance only 890 of the 910 was lodged and also a fortnights rent was paid and we were only credited for one week.
While we are happy to pay whatever arrears there are we are not confident, given the probelms in the ledger, that there amount is correct. We believe that we may be at most 9 days in arrears. HOWEVER, the ledger they have provided is missing the first 6 months of our tenancy.
The real estate we were renting through at the beginning of our tenancy was sold to another REA and now there is no record of the first 6 months of rent. Given the issues we found in the 3.5 years worth of rent ledgers we really want to go over those other months to make sure no other errors have been made… like not all of our rent being credited :|.
The PM had lodged a claim for all of our bond to pay for the arrears, we currently have a date for a tribunal hearing. Are they under any legal obligation to provide us with those first 6 months worth of rent ledgers?? I can’t seem to find any info anywhere.
