      Hi – new to this site.

      I live in a strata of 8 villas and common grounds. The villas are free-standing, with each enclosed in an individual yard. Title plans show the yards (front and back) being included in the lot.

       

      Here's the problem: A large mature (Council) tree on the street frontage has sent large roots from the street into one villa, damaging the wall and breaking up the concrete on the driveway, within the lot boundary. Council won't remove or lop the tree, or accept liability for the damage. Pursuing the Council is a different story though.

       

      The OC pays for painting of the villa building, even though it is within the lot. They also paid for repairs to the garage door. But the OC refuses to pay for repairing the damage to the fence, or to the driveway within the lot boundary. Their answer is that these items are within the lot boundary, and therefore the owner's responsibility.

       

      Can you clarify this?
