Hi,
I was hoping this forum could help me with a problem I'm having.
I've been renting this apartment for about a year now and recently the lifts in the building have been becoming very noisy, mainly because there not well maintained. Additionally they malfunction and just go between the floors with no one in them for hours on end sometimes.
It's got to the point where I often can't sleep due to the insentient screeching noise, I was hooping someone could tell me about the strata corporations obligations here. The lifts still get you from one floor to the next (with a few random stops) but my apartment is no longer what I signed up for doe to the constant noise.

Take your complaint to the Executive Committee for urgent attention and cc the Strata Managers so they are aware. If the EC do not act, you can ask the Strata Managers to offer their advice as to the steps you should take to get this rectified. If all else fails, try mediation at Dept Fair Trading. They do listen and are very helpful. That is my experience anyway.
Macfadyen's advice would be spot on if you were an owner. Unfortunately, as a renter, while you can approach the EC and ask them to do something, if they refuse, you really need to go to your landlord and ask them to put pressure on the EC to get the lifts properly maintained.
The Owners Corporation has an absolute legal duty to repair and maintain common property so your landlord has every right to demand that this be fixed.
If they are reluctant to take action, go to Fair Trading and ask them to order a rent reduction for loss of amenity until such times as the problem is fixed.
