Okay, let’s start with my opinion that the strata laws in Victoria have giant holes in them and that Victoria politicians don’t care about apartment owners. Prove me wrong if you disagree.
Fact: Vic Model Rules/strata laws are utter garbage. The OC have no ability to enforce anything within a lot – only common property, which typically is only external to the building.
So with that in mind – and after reviewing my title – I can confirm that floors between lots are not common property.

It boggles my mind that my only options are mediation via Vic Administratives Tribunal, and if that fails, VCAT. The frustrating thing is that there are no past cases available to view in the VCAT library which deal with these sorts of complaints (which there would be many) so I have no idea on what the possible outcome could be, or how to prepare.
Surely there’s a clear path to remedy that isn’t just ‘buy earplugs,’ or ‘sell.’
