Hi Whale,

I had checked the Strata Plan which is why I have the dilemma!  The dividing wall between my balcony and the one next door is not drawn as a heavy line and so is private property, with the common property boundary being drawn straight along the front of the building – including along the balcony railing.

The fact that installation was at the point of construction is what I've been clinging to, however as some (ie most) owners over the years have removed their awnings a group of existing owners are not keen to repair something that they now see as being an “extra”.  The one owner who is on my side thinks that if we go ahead and get our awnings fixed then others are going to ask for awnings to be installed – opening up another can of worms!
