I desperately need to know if the Strata Manager does not come under an Act obliging them to undertake certain duties? Our Exec was down to one last Jan (of 6 owners) when the 2nd member sold his flat. No EGM was ever called, the Strata Manager kept saying the remaining Contact fellow was good enough (he is a total control freak & absentee owner) even if “theoretically there should have been an EGM”.
Now, after submitting numerous motions for the 4th year in a row concerning water leakage to my own unit & other repairs to the building, we have had no AGM (due between 1 July & 30 Sept) & the strata Manager’s office is closing down for the festive season.
The Mediation Unit of NSW Fair Trading has told me I cannot seek mediation unless it is with the Exec. I would not be surprised if there has been no AGM so that I have no one to seek mediation with.
I don’t know what I can do, as the Strata Manager insists they cannot act without authority from Exec yet we do not have a legal Exec. Nor does the Strata Manager care. Yet we have heaps of money in the Sinking Fund.
