Insurance claims. Who pays

      Recently my apartment was flooded when a guest mistakenly left the tap on in the kitchen just before we left for a few hours. I received a call from my RE agent informing me there was water dripping into the unit below and that they had called a plumber. I returned just as the plumber arrived, We turned the tap off. There was an inch of water covering the living room. The plumber stayed one hour helping me mop up and he called a carpet cleaner. The carpet cleaner sucked all the water up. My contents insurance paid for the my damaged property. Computer, some furniture damage etc. My insurer advised they would not cover the carpet cleaning as that would be covered by the landlord insurance. The RE agent has asked me to pay $300 for the landlords insurance “Excess” and also told me I have to pay the plumber bill of $70. Am I legally required to pay the plumber and the landlords $300 insurance excess?

    PLEASE ... If your property is not in NSW, mention its location (state). Don't identify companies or individuals by name. Don't mention or promote your company or services. Keep acronyms and initials to a minimum.
