      Hi

      Our strata is in the process of trying to clean residents using visitor parking (VP), as 100% visitor parks are being used by residents. As we are near Sydney airport we also often get cars left in visitor parks long term for weeks at a time.

      We have a registered by law with a breach notice fee and a cost recovery by-law too.

      The process so far:

      1. Notices have been put up in the VP’s referencing the by-law

      2. VP checked and photographed daily

      3. Parked cars are cross referenced to CCTV and access control system

      4. strata manager sends resident one warning letter

      5.  further use of visitor parks results in breach notice(s) 

      However this is a multi-strata complex with shared facilities. All the VP’s are on the strata plan of the strata that has the registered by-law.  

      This process is working except for one (there is always one) very notable exception. The residents of one of the other strata’s feel that they have every right to use VP”s all the time.

      The question – Can the OC with the registered by-law (as the VP’s are on their strata plan) issue breach notices to the residents of the other Strata plans who are using visitor parks? The SMS does not provide the mechanism to administer breaches as it only designates the cost distribution for maintenance.
