      I’d be first bringing the issue to your property manager saying you appreciate the new paint but have found it too over-powering. They would likely be unaware. Ask them can they offer a way to rectify it as you are finding it un-liveable at this stage and may need to bail. I’m sure they’d find it easier to address it than lose you probably thinking the next guy will say the same thing if it isn’t addressed. I’d also look online for any easy do-it-yourself remedy that you can do, even if you need pay for it. You’d gain knowledge as to how long it may last at least, and I guess you might also call a painter and just ask them their advice. And don’t be overly precious about it all as being a new location for you as you will get used to many things in short time.

        I appreciate your frustration and predicament. I’m aware of a similar incident where all sides decided to tough it out and lawyer up and… Um, yeah, don’t play that long game. So far they’ve literally all spent high-hundreds of thousands of dollars on legals over years now while it moves at a glacial pace across the courts, and all units remain unsaleable  until the thing gets forced into settlement and very likely the forced sales for debt recovery for some. All the while there’s little loot to maintain their complex. Be very reasonable along the way (even when the other side seems not) to get it all concluded as soon as practical is my 2c worth.           You need to be sure the complainer isnt in fact correct on all/many/some of the things he raises.

          If the committee does their full job he has less to whine about so make sure he isnt just (poorly) pointing out things that should be addressed.

            I appreciate your kindness towards your growing collective of cats. Good for you. However, not being a cat person I wouldn’t like to see them frequenting my apartment block and assuming they make noise and mess that others don’t feel they have signed up for nor find acceptable in a shared community environment. I don’t think local Council services would support your cause in it’s current location either. But anyways, keep on keeping on but I can see some issues you might find challenging to continue with on this issue.

              This is a fair request to enable tenants to enjoy the property’s assets such as the pool or sauna or such that may be locked when not in general use. For vulnerable areas such as the cabinets for internet connection we keep these locked with a phone contact on the door so a infrequent visiting tradie can identify themself and get the nearby keysafe combo to get the key themself. Our video camera is located there just in case he forgets to return them and we can identify and chase these up.

                I will politely disagree with you kaindub. The (live-) by-laws almost always state that the appearance of an owner’s lot be kept in good and tidy condition. Sheds, random plants and noisey basketball hoops surely don’t seem to meet that requirement. Even inside is open to question should an owner have real health and safety issues that are likely to impact other owners. If you can generally see it, you are entitled to pass reasonable comment and seek rectification if you feel to.

                    My overpriced 2c worth would be to ask that it is kept clean and tidy so as not to affect amenity in the complex. I know how annoying these can be if left seemingly abandoned but registered, remaining dirty, with flat tyres, in poor repair or untouched junk on view inside.

                      Great question. FWIW you might like to vote for a) a average cost per unit for a standard replacement paid by all. Then also vote on  b) variations extra per unit as a shared cost by all owners or c) agreed variations beyond standard funded by each affected owner.

                        So essentially some dude has smashed your place and your value all without permissions? Our site’s disaster was a little more modest. That owner also sold up after the events. It was agreed with the outgoing guy that the rectification work was to be independently billed then deducted from that property’s price paid by the incoming owner who then paid for the rectification to the body corps satisfaction.

                          I’ve found it’s worth checking other providers quotes even if you have a manager doing the quote getting. I have a slightly cracked pane so sought the bcorp to address it. When I saw the manager’s rep on site and told her I got another quote. She told me the price previously accepted for a similar job of another unit here was twice the price I’d been given by another. ‘Oh well I guess you could just use your guy’ she said without the slightest concern to the cost difference. Unreal. Trust but verify.

                            Annual door inspection work in Qld is a mafioso style racket, so I’m told you must not get the same folk who do the inspection and fault finding to thereafter be the same who quote the new apparently required works. ‘Don’t ask the barber if you need a haircut’.

                            We were told we needed 46 of 50 new doors. You can sniff a rat, I’m thinking, by the number of recommended doors to be replaced v the number they say they can just repair (we were sold 46 new and 0 repairables!).

                            On the works to be done, know your committee can’t break the full cost of this into smaller jobs and sell that to owners if it’s all really just one big work order. Your committee will likely then buy into the new door colour and furniture without reaslising they can’t just totally change the look and feel from what was there.

                            That would take it from maintenance related same/same to an improvement which is subject to different spending limts and if not like for like, [meaning it] needs owners AGM motion approval – otherwise the old fools rush to buy cheap junk that owners are thereafter stuck with – esp if a few would not be at this decision making committee meeting and 3 or 4 folk without any expertise will win the vote and the over-priced value destructive stuff goes in… which it can’t remain in when someone thereafter tells them they can’t and then you all pay for the rectification.

                            Finally when any new stuff does go in, ensure someone capable checks it. In our case at least one of the new beaut mismatched painted doors with silly handles and wrong locks was delivered and installed 20 mm too short so not to new spec and sure to be pinged when the same guys come back for next years inspection.

                            And to help avoid that ensure all owners are properly briefed on what they can and can’t do to keep the new doors up to spec – as in, put your own peep hole in and we need replace the whole door.

                            Final thought would be: it wouldn’t be hard and certainly neighborly if the committee gave owners the choice to stump up and pay the little extra to have the internal side colour painted to match their interior colour scheme if this has been changed during any reno work they make have done before their own painter packed and left at a time prior, rather than be forced have the same exterior colour forced upon them inside their home.

                            Our story is yet to run out but it’s been a horrible stressful affair for those of us trying to avoid the death by 1000 cuts here.

                              Hi Jimmy, good post. I recently read that balcony bbq’s are a leading cause of fire in apartment blocks in the UK. So the issue can create much greater problems than just someone’s burnt snag. I recently had this issue in Qld where the neighbor below placed his bbq on his balcony under my own.

                              Fortunately I had just shifted my washing from there but it did come straight into my bedroom and I first noticed it when sitting in another room so it was annoyingly smokey. Fortunately in a round about way I directly advised the bbqers wife and it hasn’t been repeated.

                              Hostile responses might include putting a smoke alarm on your balcony edge and if it goes off just let it ring out while you slip out for a coffee, or screaming fire and drenching it from your place with a curtain of water or cranking up your own stereo – immature for sure, but if they can expresss themself with smoke signals maybe you can too in your own way?

                              Our place has recently purchased a community use bbq so with that available and being located out of the way that might even be the better option.

                                Without prior approval for the works and quote it might be hard to get reimbursed especially if it’s not for common property benefit – trust me I’m finding out just how pedantic committees can be in this regard. And trying to take action after doesn’t get far. But on the other side, after 12 months of being in place the owner would be most likely to defend any direction to restore the original lock sets. If they were deemed that offensive your committee should have jumped on them quicker. Ideally, and if the locks were serviceable, the way forward for the owner would be to have someone pay a locksmith to change the key/barrels to prevent former occupants strolling in with the same old key.

                                  Im in Qld. If Vic is similar the titles of Chair, Sect and Treasurer dont carry any more sway than other committee members other than a couple more duties. But in short they are of no higher value or status.

                                  Many dont appreciate that as a fact, so dont feel 2nd class or that they are entitled to any extra weight in your committees choices. I say that so you can feel to throw your equal weight to the degree they do.

                                  I also suggest you google and download your State’s b corp related Act/legislation which is the text that counts for your operational approach and is the basis of any outsider adjutication. Knowing it, quoting it and pointing to it tends to seperate fact from opinion.

                                  It’s surprising how much erroneous thought intentionally or ignorantly is used to blind the masses. And any decisions shovelled through shown to breach the legislation can be forceably reversed which would embarrass the folks in the wrong so theyd want to avoid that. Anyways all the best and i hope it helps in some way or other.
